Summary: The Perris Union High School District previously issued a Request for Proposals ("RFP") seeking a contractor to conduct work on improvements at Paloma Valley High School (the "Project") and, after evaluating each proposal based on the "best value" criteria, awarded the contract to Miller Construction ("Miller") as the Lease-Leaseback contractor for the Project via Resolution No. 12:21-22 on December 15, 2021. The District and Miller executed the Site Lease and Facilities Lease governing the work on the Project and negotiated a GMP for Phase I of the Project in the amount of $380,352.80. The District's Board approved the GMP for Phase I at the August 17, 2022 Board meeting. The Phase II guaranteed maximum price ("GMP") was determined after subcontractor bids were reviewed, and subcontractors were selected through a competitive process. The District and Miller have determined and finalized a GMP for Phase II of the Project in the amount of $50,432,320.39, and the Division of the State Architect ("DSA") approved the Project plans and specifications. The District seeks Board approval to enter into and approve Amendment No. 1 to Exhibit A, the Facilities Lease, and approve the GMP for Phase II. Approval of this agenda item approves Amendment No. 1 to Exhibit A of the Facilities Lease and approves the Phase II GMP.
Funding: The cost for this item is included in the 2023-24, 2024-25, 2025-26, and 2026-27 operating budgets funded through Various Facilities Funds, not the General Fund.
Recommendation: It is recommended that the Board of Trustees approve Amendment No. 1 to Exhibit A to the Facilities Lease and a Guaranteed Maximum Price for Phase II for the Lease-Leaseback Agreement between Perris Union High School District and Paul C. Miller Construction for work at Paloma Valley High School.
