Subject: 14.17 BUILDING & GROUNDS: Approval of Pool Completion Phase Guaranteed Maximum Price for Lease Leaseback Construction at Perris High School and Authorize Execution of Addendum D to Exhibit A to the Facilities Lease (funded through Various Facilities Funds at a total cost for Pool Completion Phase, not to exceed $10,270,803.65 not the General Fund)

Summary: The District previously issued a Request for Proposals (“RFP”) for contractors to conduct work on improvements at Perris High School (“Project”) and awarded the contract to Miller Construction (“Miller”) as the Lease-Leaseback contractor for the Project. The Board previously approved $75,000 for Miller’s preconstruction services to be provided as Phase 1 of the Project. The fee for construction (Phase 2) has been approved in multiple increments, totaling a guaranteed maximum price (“GMP”). A GMP is developed by way of competitive bidding for each increment of the work. Miller previously competitively bid the work required as follows:

Increment 1: GMP of $8,025,051.69, Board approved on March 18, 2020.
Increment 2: GMP of $597,895.80, Board approved on June 17, 2020.
Increment 3: GMP of $58,893,269.17, Board approved on October 21, 2020.

Miller has now competitively bid the work required for Increment 4, the Pool Completion Phase. As a result, the District and Miller have negotiated a GMP for Increment 4, the Pool Completion Phase, in the amount of $10,270,803.65. The District seeks Board approval of this GMP for Pool Completion.

Approval of this item accepts the Pool Completion Phase GMP and authorizes execution of Addendum D to Exhibit A to the Facilities Lease, allowing work on the Pool Completion to proceed.
Funding: The cost for this item is included in the 2021-22 operating budget funded through Various Facilities Funds, not the General Fund.
Recommendation: It is recommended that the Board of Trustees approve the pool completion phase guaranteed maximum price for lease leaseback construction at Perris High School and authorize execution of Addendum D to Exhibit A to the Facilities Lease.
