Resolution No. 13_20-21 Authorizing Request for Waiver.pdf
Summary: California Education Code Section 33050 (“Waiver Law”) authorizes the governing board of school districts to request the State Board of Education (the “SBE”) to waive all or part of any statutory requirements of the Education Code, except for those provisions which the Waiver Law exempts from waiver.

An election was held in the Perris Union High School District (the “District”) on November 6, 2012 for the issuance and sale of general obligation bonds of the District for various purposes in the maximum amount of $153,420,000 (“Measure T”). In order to issue the remaining bonds authorized under Measure T, the District will require a waiver of a statutory provision which limits the total amount of bonds that can be issued by the District to 1.25% of its current assessed valuation. The Resolution before the Board would authorize the filing of a waiver request under the Waiver Law for such a purpose. The Resolution would authorize District staff to complete all necessary documentation and take any additional actions required by the SBE in order to facilitate the approval of the waiver request.

The District is required by the Waiver Law to hold a public hearing prior to the adoption of the resolution. A Public Hearing regarding the Waiver has been scheduled for March 17, 2021, at which members of the public may be heard. The Resolution will be considered at the conclusion of the Public Hearing. The District provided notice of the Public Hearing, stating the time, place and date of such Public Hearing.
Funding: No fiscal impact.
