Summary:
|
The District was approached by Global Investment Pool, LLC (“GIP”), the land owner of a parcel adjacent to Liberty High School identified in Tract Map 36785, with a request to execute an agreement detailing how water flows would be permitted across the shared property lines. The agreement, negotiated with the assistance of legal counsel, provides in part that the parties will agree to a certain magnitude and concentration of water flow between the parcels. The agreement also places conditions on the nature of these flows of water and specifies a notice and cure process and dispute resolution process that the parties will use should a dispute regarding these flows arise. GIP has requested to record this agreement against both parcels.
