Summary: The Perris Union High School District (PUHSD) has retained the services of qualified special tax consultants, Koppel and Gruber Public Finance, to administer Community Facilities District (CFD) Nos. 91-1 and 92-1. Koppel and Gruber Public Finance (K&G) was selected as the District’s CFD Administrator based on several factors as determined to meet the needs of the District. These factors include understanding of the work required by the District; demonstrated competence and professional qualifications necessary for successfully performing work required by the District; experience in successfully performing similar services; proposed approach in completing the work; background and related experience of the specific individuals to be assigned to this project; and their proven services as provided to PUHSD.

In addition to CFD Administration, K&G performs other necessary services as it relates to public finance as well as the assessment of school fees. They have successfully completed the annual School Facilities Needs Analysis (SFNA) for several years and have performed continuing disclosure and arbitrage calculations as well. An SNFA is prepared pursuant to Government Code Sections 65995.5, 65995.6, and 65995.7, as well as Education Code Section 17620, to justify Level II and Level III Alternate School Fees. Continuing disclosure reports are required under SEC Rule 15c2-12 and in accordance with disclosure certificates for the District’s bond issuances. Arbitrage calculations must also be prepared for bond issuances pursuant to Section 148 (f) of the Internal Revenue Code of 1986. Koppel and Gruber Public Finance will also Prepare an Annual and five-year Developer Fee Report in compliance with Government Code Section 66001 and 66006.

The annual cost to administer CFD No. 91-1 is $3,980. The annual cost to administer CFD No. 92-1 is $16,450. The annual cost for delinquency administration, payable on a per parcel basis, is estimated not to exceed $15,000. Continuing disclosure services and arbitrage calculations, payable on a per bond issue or per calculation basis, are estimated not to exceed $10,000. The base cost to perform the annual SFNA is $11,360, the fee justification study is $8,675, and the Annual and Five Year Developer Reports are $2,770 per report. In conjunction with these services, K&G may perform additional work if authorized by the District. This will be compensated on a per-task basis or on an hourly basis as defined within the contract. It is estimated that additional work will not exceed $15,000. The total cost for services is approximately $86,000 per year, based on estimated work needed and anticipated thus far.

This Agreement shall be for three (3) years beginning July 1, 2022, through June 30, 2025.

This Agreement is being brought before the Board as ratification due to the untimely receipt of the Agreement.
Funding: The cost for this item is included in the 2022-23, 2023-24, and 2024-25 operating budgets funded through the Community Facilities District 91-1 and 92-1, and the Capital Facilities Fund, not the General Fund.
Recommendation: It is recommended that the Board of Trustees ratify the Multi-Year Professional Services Agreement with Koppel and Gruber Public Finance for consulting services.
