Summary: On April 21, 2021, the Board of Trustees awarded the contract for Special Inspections and Testing Services for the Heritage High School Aquatic Center Project to River City Testing. On November 30, 2021, the District received notification from the Division of State Architects (DSA) that River City Testing was no longer a DSA approved Laboratory of Record (LOR) and would have to seize and desist any work with the District immediately. Title 24, Part 1, Section 4-335 requires that special inspections and testing for construction projects under the jurisdiction of the Division of State Architects (DSA) be performed by testing facilities acceptable to the DSA. Due to the loss of their LOR approved status, River City Testing was notified that their contract was being terminated on December 10, 2021. District Facilities Staff obtained a proposal from Atlas Technical Consultants, LLC (ATLAS). ATLAS is currently providing these services for the Paloma Valley High School Aquatic Center Project. For expediting purposes and to prevent any disruption of work, the District entered into an Agreement with ATLAS for special inspections and testing services for the Aquatic Center at Heritage High School. The services are being provided at an estimated project cost of $247,001.


The term of this Agreement shall be for one (1) year from December 9, 2021, through December 8, 2022.


This item is being brought before the Board as ratification to prevent any potential delays due to the removal of River City Testing from the project by the DSA.
Funding: The cost for this item is included in the 2021-22 operating budget funded through Various Facilities Funds, not the General Fund.
Recommendation: It is recommended that the Board of Trustees ratify the Agreement with Atlas Technical Consultants, LLC for special inspections and testing services for the Heritage High School Aquatic Center Project.
