Summary: School Fees apply to new residential and commercial/industrial construction within a school district and are authorized by the State Allocation Board ("SAB"). The maximum per square foot fee amounts are established by the SAB, and were updated as of February 2022 as follows: for residential construction or reconstruction, $4.79 per square foot; for commercial/industrial construction, $0.78 per square foot.

Koppel & Gruber Public Finance prepared the fee justification study entitled “Perris Union High School District School Fee Justification Study” (“Fee Study”), which reflects the average student generation rates, amount of projected future development and costs of necessary school facilities to accommodate students generated from such construction.

As noted above, the maximum per square foot amounts are established by the SAB for unified school districts and are currently as follows: for residential construction or reconstruction, $4.79 per square foot; for commercial/industrial construction, $0.78. However, pursuant to Education Code section 17623(a), the District, as a nonunified school district sharing common jurisdiction with other nonunified school district(s), has entered into a fee sharing agreement with Perris Elementary School District (“PESD”), Menifee Union School District (“MUSD”), Nuview Union School District (“NUSD”) and the Romoland School District (“RSD”). The agreement specifies the percentage of the maximum School Fees that may be levied and collected by each school district. According to the agreement, twenty eight percent (28%) of the maximum School Fees may be charged and collected by the District for areas within the District boundaries shared by MUSD, NUSD and RSD, or $1.34 per square foot for residential and $0.2184 per square foot for commercial/industrial development. Rental self-storage shall be levied only in the amount of $0.07 per square foot. The agreement also specifies that forty percent (40%) of the maximum School Fees may be charged and collected by the District for areas within the District boundaries shared by PESD, or $1.92 per square foot for residential development and $0.3120 per square foot for commercial/industrial development. Based on the findings presented in the Fee Study, the District is justified in collecting its portion of the maximum residential and commercial/industrial School Fees, except rental self-storage shall be levied only in the amount of $0.11 per square foot.

Notice of consideration of the Fee Study and the adoption of the School Fees has been published in accordance with legal requirements. After the public hearing, the Board shall consider whether to approve the Fee Study and adopt by resolution the School Fees justified by the Fee Study. After adoption of the Fee Study and the new School Fees, District staff will give notice to relevant local agencies.
Funding: No fiscal impact.
Recommendation: It is recommended that the Board of Trustees hold a Public Hearing to receive comments from the public or interested parties regarding the increase in Level 1 Statutory School Fees as justified by the Fee Study.
